HONOURABLE JUSTICE G. SRI DEVI I.A.Nos.2 and 3 of 2019 In/and CRIMINAL PETITION No. 7250 of 2019 ORDER:

The petitioners, who are A1 to A3 in C.C.No.118 of 2018 on the file of the VIII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, filed this Criminal Petition under Section Cr.P.C.

to quash the proceedings in the above C.C. A charge sheet came to be filed against the petitioners for the offences punishable under Sections 420, 468 and 471 r/w 34 IPC.

2. The de facto complainant/2nd respondent and the accused are personally present before this Court and they have beem duly identified their respective counsel. For the purpose of identification, the parties have furnished copy of Aadhar Cards and photographs, which have been duly identified by their respective counsel. I.A.Nos.2 and 3 of 2019 are filed to record the compromise and to compound the offences. Along with the petitions, a joint compromise memo came to be filed, which is supported by the affidavit of the complainant. The affidavit and the joint compromise memo are duly signed by the respective parties and their signatures are also duly identified by their respective counsel.

According to the affidavit, the parties have settled their civil disputes before Lok Adalat, City Civil Court Legal Services Authority on 19.09.2018. At the time of settlement of the civil suit before the Lok Adalat, both parties have compromised the matter. As per the terms of compromise, the parties have agreed to withdraw all pending civil and criminal cases filed against each other. The de facto complainant/2nd resondent has also agreed to withdraw the present C.C.No.118 of 2018 on the file of the VIII Addl.

Hence, the de facto complainant/2nd respondent has no objection to quash the proceedings against the petitioners.

4. In the light of the compromise arrived at between the parties, the compromise memo filed by both the parties is recorded and I.A.Nos.2 and 3 of 2019 are ordered.

Accordingly, the Criminal Petition is allowed in terms of compromise, and the proceedings in C.C.No.118 of 2018 on the file of the VIII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, against the present petitioners-A1 to A3 are hereby quashed.
