SHANKAR NARAYANA Writ Petition No.30309 of 2017 Order: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) The E-auction notice dated 1.7.2017 fixing the date of auction as 7.8.2017 was subjected to challenge in W.P. No. 24238 of 2017. As no bidders came forward to purchase the subject properties, apart from three items which were sold and the sale confirmed, a fresh E-auction notice dated 19.8.2017 was published on 22.8.2017 for the remaining properties fixing the date of auction as 7.9.2017 and 8.9.2017. Sri M. Srikanth Reddy, learned Standing Counsel for the respondent-bank, on instructions, states that, since no bidders came forward in the auction held on 7.9.2017 and 8.9.

2017, the respondentbank would proceed to conduct an auction afresh. Sri G. Suresh Goud, learned counsel for the petitioner, states that, as no bidders came forward in the auction, the cause in this writ petition would not survive, and it would suffice if the petitioner is granted liberty, in case, a notification is issued afresh by the respondents, to question the same in appropriate legal proceedings. Granting liberty as sought for, the Writ Petition is dismissed as infructuous. Miscellaneous Petitions pending, if any, shall also stand dismissed.
