THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.550 of 2017 ORDER:

This criminal petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed to grant prearrest bail to the petitioners/A.1 to A.3, who are apprehending arrest in connection with Cr.No.682 of 2016 of Pet Basheerabad Police Station, Cyberabad Commissionerate, Ranga Reddy District, Telangana State, registered for the offence punishable under Sections 498-A of Indian Penal Code, 1860 (for short 'I.P.C.') and Sections 3(1)(s) of SC & ST (POA) Act, 1989.

After arguing the matter for a while, learned counsel for the petitioners seeks a direction from this Court to permit the petitioners to surrender before the VII Additional Sessions Judge-cum- Special Judge for trial of cases under the SC & ST (POA) Act having jurisdiction over the area and move an application for grant of bail, which shall be decided on the same day, without going into the merits of the case.

Acceding to the request of learned counsel for the petitioners, I deem it appropriate to permit the petitioners to surrender before the VII Additional Sessions Judge-cum- Special Judge for trial of cases under the SC & ST (POA) Act having jurisdiction over area and move an application for grant of bail, in which event, the learned Sessions

- 2 - Judge is directed to decide the same on the same day, after serving notice to the Public Prosecutor.

With the above observation, the Criminal Petition is disposed of.
