THE HON'BLE SRI JUSTICE M.S.K.JAISWAL Writ Petition No. 32709 of 2012 ORDER:
The writ petition is filed seeking to declare the action of the 5th respondent in not following the provisions of Sec.29 of A.P. Charitable and Hindu Religious Institutions and Endowments Act, 1987 (for short, 'the Act;), and also the orders of this Court in W.P.No.24498 of 2010, dated 28.02.2011, as illegal and arbitrary. 2.
The original grievance of the writ petitioner is against the then Executive Officer of the 5th Respondent, namely Smt.Y.Shirisha, alleging that the provisions of the Act are not being followed.

It is now submitted by the learned counsel for the petitioner that during the interregnum, the said Executive Officer has been transferred and now the petitioner has no grievance against the 5th respondent. However, the learned counsel for the petitioner submits that the Executive Officer, who ever is appointed, shall follow the mandatory provisions of the Act and should not act in contravention of the provisions of the Act, more particularly with reference to Sec.29 of the Act.

In view of the above, the subject matter of writ petition has become infructuous, and therefore, the same is accordingly dismissed. It is needless to say that the Executive Officers shall
strictly act in accordance with the provisions of the Act, more particularly as per Sec.29 of the Act. As a sequel, the miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs.
