O R D E R

The prayer of the petitioner in this case is as under: 'For the reasons stated in the accompanying affidavit the petitioner prays that this Hon'ble Court may be pleased to issue a writ or order or direction, more particularly one in the nature of WRIT OF MANDAMUS, declaring the action of the 3rd Respondent in not taking any action against the 4th Respondent for the offence U/Sec. 420 of IPC in F.I.R. No. 388/2013 of P.S. Armoor, and also not filing any Charge Sheet by the 3rd Respondent as per Sec. 154 (1) (i) and 157(1)(b)1 of Cr.P.C.

which is violation of Article - 14 of the Constitution of India and is also arbitrary, bad and illegal, consequently direct the 3rd Respondent to enquire into the matter and take steps as per Criminal Procedure Code as stated supra, in the interest of justice and pass such order or orders as this Hon'ble Court may deem fit and proper in the Circumstances of the case.' Written instructions dated 20.04.2016 were furnished by the SubInspector of Police, Armoor Police Station, Nizamabad District, stating that in so far as Crime No.388 of 2013 is concerned, upon due completion of the investigation, the police filed a final report before the learned Judicial Magistrate of First Class, Armoor, referring the case as civil in nature vide No.351/SDPO-Arm/2014, dated 16.02.2014.

The petitioner was stated to have been given due notice of this as long back as on 16.02.2014.

In the light of the aforestated developments, it is for the petitioner to take recourse to appropriate remedies in accordance with law if he is aggrieved by the conclusion arrived at by the police authorities. Reserving liberty to do so, the writ petition is closed. Pending miscellaneous petitions shall also stand closed in the light of this final order. No order as to costs.
