THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.13182 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue a writ more in the nature of writ of Mandamus declaring the inaction of the respondent No.2 and 3 for not treating the consolidated service period from 15.10.1985 to 28.03.1988 as regular service and accordingly by revising the pay scale and seniority in respect to the petitioner, even after Managing Committee of the 3rd respondent passing favourable Resolution No.7 dated 11.09.2015 or considering the representation dated 29.02.2016, as arbitrary, illegal, discriminative, in violation of the Fundamental Right guaranteed under Constitution of India and pass such other order or orders as are deemed fit and proper in the circumstances of the case."

2. Heard Sri Srinivas Basava, learned counsel, appearing for the petitioner and learned Government Pleader for cooperation, appearing for the respondents.

3. When the matter is taken up, it is represented by the learned counsel for the petitioner that for redressal of the grievance of the petitioner, petitioner herein submitted a representation dated 29.02.2016 to the 2nd respondent herein and no orders have been passed on the said representation so far and a copy of the same is also placed on record. It is further requested by the learned counsel that necessary direction may be issued to the respondent to pass appropriate orders on the said representation, in accordance with law, by fixing some timeframe.

4. Recording the said submission and having regard to the nature

of controversy, Writ Petition is disposed of, without expressing any opinion on the merits and demerits of the matter and entitlement of the petitioner, directing the 2nd respondent herein to consider and pass appropriate orders on the representation dated 29.02.2016 said to have been submitted by the petitioner herein, in accordance with law, within a period of two months from the date of receipt of a copy of this order.
