THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI SECOND APPEAL NO.1244 OF 2005 JUDGMENT:

When this Second Appeal is taken up for hearing, Sri M.Subba Reddy, learned counsel for the appellant, submits that letter dated 15.08.2015 (received on 17.08.2015) is filed before the learned Registrar (Judicial) of this Court stating that the appellant has personally informed the counsel that the matter is settled out of Court and was compromised and therefore, he intends to withdraw the appeal and therefore, permission may be accorded by listing the Second Appeal under the caption "For Withdrawal" to enable the appellant to withdraw the appeal. He would further submit that in view of the contents of the letter and the instructions received by him, the appeal may be dismissed as withdrawn.

Recording the submissions of the learned counsel for the appellant, the Second Appeal is dismissed as withdrawn. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand dismissed.
