THE HON'BLE DT. JUSTICE CHILLAKUR SUMALATHA CRIMINAL PETITION No.7OSO of 2022 ORDER:

Seeking to quash the proceedings that are pending against the petitioners/Accused No.1 and 2 in C.C. No.6472 of 2019 on the file of the Court of III Metropolitan Magistrate at L.B. Nagar, Ranga Redclv District, the present Criminal Petition is filed. 2.

He:rrd Sri Amrutha Sanjeev, learned counsel for the petitioners/ Accused No.1 and 2, ald as well as the learned Assistant Public Prosecutor, who is representing respondent No.1 - State. Having regard to the limited request made by learned counsel for the petitioners, issuance of notice to respondent No.2/defacto complainant is felt not necessa-ry. 3.

l,earned Counsel for the petitioners submits that petitioners have not committed any offence whatsoever and they never I demanded any additional dowry as narrated in the charge-sheet, therefore, proceedings against them are not maintainable. Further, learned Counsel states that no further orders in this !

Criminal petition are required except to dispense with attendance of the 2"d petitioner before the trial Court on each and every date of adjournment as she is al aged woman. Learned Aspistant

Dr CSL.J Crl.P.No.7050 of2022 Public Prosecutor did not raise any serious objection for grant of such relief.

The Crimina-l Petition is therefore disposed of with .the following directions:

(1) The Court of III Metropolitan Magistrate at L.B. Nagar, Ranga Reddy District is directed not to insist the personal appearance of petitioner No.2/Accused No.2 in C.C.No.6472 of 2019 that is pending before the said Court during the course of proceedings, in case she is represented by arl Advocate. (21 However, the petitioner/Accused No.2 shall make her appearance before the trial Court in case a specific direction to that eflect is issued.

(3) It is made clear that such an exemption is not granted as far as petitioner No.1/Accused No.1 is concerned As a sequel, miscellaneous petitions pending, if any, shall .L stand closed.
