THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M. SEETHARAMA MURTI CONTEMPT CASE No.1807 of 2017 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) This contempt case was instituted by the first respondent in W.P.No.26366 of 2014 alleging wilful disobedience to the order dated 13.10.2016 passed by this Court in W.P.M.P.No.32985 of 2014 filed in the said writ petition.
W.P.No.26366 of 2014 was filed by the Government of Andhra Pradesh and its officials assailing the order dated 08.10.2012 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.No.8002 of 2012. W.P.M.P.No.32985 of 2014 was filed by them in the said case seeking suspension of the impugned order of the Tribunal pending the disposal of the writ petition. By the order dated 13.10.2016, this Court opined that no reasons were made out for grant of interim relief and accordingly dismissed the W.P.M.P.
In effect, there was no adjudication and this Court merely refused to suspend the order under challenge in the writ petition. That being so, contempt proceedings would not lie before this Court in relation to disobedience to the order passed by the Tribunal. The contempt case is accordingly dismissed leaving it open to the petitioner to take appropriate measures in accordance with law. No order as to costs.
