HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.45044 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to quash the proceedings against him in FIR No.80 of 2016 on the file of the 3rd respondent. 2.

Heard and perused the material available on record. 3.

The above crime was registered for the offence under Sections 468 and 420 r/w 511 IPC against the petitioner alleging that one T. Rajendran presented a cheque issued by EDIS Publishing and Promotional Packaging Private Limited, Bangalore, at single window counter of the Bank. After verifying the cheque, the Bank employee got suspicion and brought the same to the notice of the 4th respondent. Meanwhile, the said Rajendran left the Bank premises. The allegation against the petitioner is that the said cheque was given by the petitioner to the said T. Rajendran. It is the case of the petitioner that he did not commit any offence and basing on the confession of the said Rajendran, the name of the petitioner was included. 4.

The petitioner filed this writ petition challenging the investigation in the above crime. This Court is not inclined to interfere with the investigation in the above crime. However, the petitioner is directed to surrender before the Station House Officer concerned and execute a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with one surety for the like sum to the satisfaction of the Station House Officer concerned. On such surrender and on execution of personal bond, the Station House Officer concerned is directed to release the petitioner and complete the investigation and file a final report, without arresting the

petitioner. The petitioner is directed to appear before the Station House Officer concerned as and when required.
