HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION NO.4288 OF 2017 ORDER:
Petitioner/ A-2 seeks regular bail in Crime NO.139 of 2016 of Police Station, Rangampeta, East Godavari District, registered for the offence under Section 8 (c) read with Sec.20B(1) of NDPS Act. When the matter come up for hearing, learned Addl.P.P. while opposing bail would submit that the commercial quantity of ganja was seized from the possession of both the accused and the case was numbered as S.C.No.139 of 2016, charges were also framed and the matter is coming up for fixing the schedule and therefore, at this stage bail may not be granted. Learned counsel for the petitioner would submit that the accused has been in custody since 26.01.2016 and that A-1 was already enlarged on bail.
A perusal of the order in Crl.P.No.8103 of 2016 dated 27.06.2016 would show that petitioner/ A-1 was indeed granted bail but considering his ill-health and immobilised condition. Therefore, the grounds on which A-1 was enlarged on bail are of no avail to petitioner/ A-2. In this case, commercial quantity of 70 kgs. of ganja was seized from the possession of the accused and the case is under the stage of fixing schedule. In these circumstances, while dismissing this bail application, the trial Court is directed to complete the trial and dispose of the case on merits within five months from the date of receipt of a copy of this order. Registry is directed to forward the copy of this order forthwith to the trial Court.
