The present Writ Petition came to be filed declaring the action of respondents in threatening the petitioners to vacate from the land admeasuring Acs.30.00 cents in R.S.No.11/1 situated at Mallavalli Village, Bapulapadu Mandal, Krishna District, as illegal and arbitrary.
Though various grounds are raised in the Writ Petition, learned counsel for the petitioners restricts his prayer seeking a direction to the respondents not to evict them without following due process of law.
No counter affidavit is filed by the respondents. On 03.02.2012, this Court while issuing rule nisi, directed the respondents not to interfere with the possession of the petitioners over the subject land, except in accordance with the due process laid down by law.
Since the request of the petitioners is to direct the respondents to follow due process of law before taking any coercive action and having regard to the interim order passed by this Court, the present Writ Petition is disposed of directing the respondents not to interfere without following due process of law in respect of the land admeasuring Acs.30.00 cents in R.S.No.11/1 situated at Mallavalli Village, Bapulapadu
Mandal, Krishna District. No costs.
