THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 24647 of 2019 O R D E R:

The allegation against the petitioner is that he is tapping the electricity without there being any meter.

Learned counsel for the petitioner contends that as a matter of fact, there is a service connection bearing No.S3027449 in respect of the premises in question and the above said allegation is blatant lie. In support of his contention, he produced before this Court the electricity bill issued on 17.09.2019.

A careful perusal of the above said bill discloses that the same relates to premises bearing Nos.62 to 72 and 82, whereas even in the cause title of the writ petition, it is mentioned that he is the beneficiary of plot Nos.62 to 72, 82 to 85.

In other words, prima facie, the allegation of the respondents is that the bill dated 17.09.2019 is only with respect to part of the premises in question and for the balance part, there is no power connection and there is no explanation how the petitioner is using the power for plot Nos.82 to 85.

In those circumstances and considering the fact that the provisional assessment notice has already been issued to the petitioner, the respondents shall restore the power supply to the petitioner subject to his depositing 50% of the amount of

Rs.1,32,492/-, subject to final assessment to be made by the respondents in accordance with law.

Subject to the above, the writ petition is disposed of. The respondents shall consider the explanation submitted by the petitioner in the enquiry uninfluenced by any of the observations made in this order.
