HON'BLE MRS. JUSTICE ANIS ASMP NO.560 OF 2017 AND APPEAL SUIT No.2809 of 2004 COMMON JUDGMENT:

ASMP No.560 of 2017 is filed by the petitioner/ 1st respondent in the Appeal to dismiss the appeal as abated since sole appellant died on 23-12-2014 and no steps have so far been taken.

When the matter is called, it is represented by both counsel that sole appellant died in the year 2014, but no steps are taken till this day.

In view of the above submission, ASMP No.560 of 2017 is allowed and thereby the Appeal Suit is dismissed as abated. No order as to costs.

Miscellaneous Petitions, if any, pending in this Appeal Suit shall stand closed.
