THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.1373 OF 2017 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C to enlarge the petitioner on anticipatory bail in the event of his arrest in connection with Crime No.225 of 2016 of Mahabubabad Town Police Station, Mahabubabad District, registered for the offences punishable under Sections 290 and 324 IPC.

After arguing the matter for some time, learned counsel for the petitioner requested the Court to issue a direction to the petitioner to surrender before the Court and on such surrender, if any application is filed under Section 439 Cr.P.C., seeking bail, the Court may be directed to decide the application on the same day. 3.

Acceding to the request of learned counsel for the petitioner and considering the material available on record, I deem it appropriate to decide the criminal petition without touching the merits of the case.

Accordingly, the Criminal Petition is disposed of permitting the petitioner to surrender before the Judicial Magistrate of First Class, Mahabubanad and on such surrender, the Magistrate is directed to decide the application for bail, if any, on the same day, subject to giving notice to the learned Public Prosecutor. _________________________________________ JUSTICE M.
