Heard counsel for petitioner and the Assistant Government Pleader for respondents.
The inaction of respondents 1 and 2 in considering the proposals submitted by respondents 3 and 4 for inclusion of lands of petitioner in an extent of Ac.10-00 in Sy.Nos.461 and 463 of Talupurpadu Village, Sangam Mandal, Sri Potti Sriramulu Nellore District under Yerracheruvu scheme for lifting water from Kavali canal on permanent basis, is complained as illegal, arbitrary and violative of principles of natural justice. Having regard to the nature of grievance the petitioner has, without entering into merits of the matter, the writ petition can be disposed of by this order.
The writ petition is, accordingly, disposed of with liberty to petitioner to re-submit the representations dated 01.09.1993, 13.09.2011 along with copy of communication dated 20.10.1993 to respondents within two weeks from date of receipt of a copy of this order. Respondents 1 and 2 are directed to communicate to petitioner the decision taken on the representations of petitioner within a further period of two months. There shall be no order as to costs.
Consequently, pending miscellaneous petitions, if any, also stand disposed of.
