HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 21654 of 2003 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the proceedings dated 06.09.2003 issued by the 1st respondent and consequential proceedings of the 2nd respondent dated 30.09.2003 promoting the 4th respondent to the post of School Assistant with effect from 26.09.2003, as illegal and arbitrary. A consequential direction is also sought to the respondents to consider the case of the petitioner for promotion to the post of School Assistant in the 3rd respondent school with effect from 01.07.2002. The grievance of the petitioner is that the 4th respondent was promoted as School Assistant is in violation of the rules in force. When the matter is taken up for hearing, it is brought to the notice of the Court by the learned counsel for the petitioner that the 4th respondent has attained the age of superannuation.

In view of the above, this Court feels that the writ petition can be disposed of with a direction to the respondents to consider the case of the petitioner for promotion to the post of School Assistant. Accordingly, the writ petition is disposed of directing the respondents to consider the case of the petitioner for promotion to the post of School Assistant, in accordance with the rules, if not already promoted, within four weeks from the date of receipt of a copy of this order.
