Notice of :he respondent served. Remained absent. This Tr.C MP is filed under Section 24 of C.PC seeking withdrawal of {MOP.No.363/2O2I pending on ttre file of the Judge, Family Court, Warangal, to transfer the same to the Judge, Family Court at Hyderabad.
As per tl e averments in the affidavit and cause title, the responder t-husband is a resident of United States of America and it is submitted by the learned counsel for petitioner tha, except the fact that the parents ol the respondent a: e residing at Warangal, no cause of action arose in the I mits of Warangal. That apart, the petitioner along with ht r minor child are living at Hyderabad and therefore cons idering the convenience of the petitioner-wife and her minor child, provisions of Section 19(iii)(a) of Hindu Marriage Act and provisions of Section 24 CPC, I find justification ir the request of the petitioner. In the result, TT.CMP is allowed and HMOP.No.363 12021 pending on the file of the Judge, Family Court Warangal, is ordered to be ivithdrawn and
t\ transferred to the Judge, Family Court, City Civil Court, Hyderabad, for disposal in accordance with law. Learned Judge, Family Court, Warangal, shall transmit the entire record duly indexed. No order as to costs.
