HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.12709 of 2014 ORDER:

The petitioner seeks Writ of Mandamus declaring the action of the respondents in not conducting survey and fixing the boundaries of the land of the petitioner admeasuring Ac.4.00 in Sy.No.307/2 in Paswemula Village, Macherla Mandal, Guntur District as illegal and arbitrary and consequently direct the respondents to conduct survey and fix the boundaries.

2) Learned Assistant Government Pleader for Revenue appeared on behalf of respondents and on instructions, would submit that petitioner has filed online application (Fline petition) through Meeseva Vide No.DER04310553 to conduct survey to the schedule land however the land was not surveyed due to objections raised by the purchasers as the petitioner has sold away the above said scheduled land to Mudavatu Tulasiram and Chandu Naik in the year 2001 vide registered Document No.257/2001 of SRO, Macherla. To this effect, learned AGP produced Encumbrance Certificate issued by SRO, Macherla showing that the land in an extent of Ac.4.00 in Sy.No.307/2 was sold by Katavatu Hemla (Petitioner) to Mudavatu Tulasiram and Chandu Naik and the sale deed was registered on 24.04.2001. Learned AGP thus prayed to dismiss the writ petition.

3) There is no representation for writ petitioner.

4) It appears, since the subject land was sold away by the petitioner, he is no more interested to prosecute the writ petition. 5) Accordingly, the Writ Petition is dismissed. No costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
