HON'BLE SRI JUSTICE A RAMALINGESWARA RAO WRIT PETITION No.26280 of 2015 ORDER:
The petitioner was appointed as fair price shop dealer of shop bearing F.P.No.8, Gandlavaripalli Village, Mudigubba Mandal, Anantapuram District. The shop was inspected and based on the inspection, the Tahsildar submitted a report on 13.03.2015. On the basis of the said report, a show cause notice was issued on 23.03.2015, levying four charges against the petitioner and the petitioner submitted explanation on 30.03.2015. Thereafter, the authorization of the petitioner was suspended on 01.08.2015. Challenging the same, the present writ petition is filed.
This Court carefully perused the charges leveled against the petitioner and the explanation submitted by the petitioner. The said allegations warrant enquiry. In the circumstances, this Court is not inclined to interfere with the enquiry at this stage. However, the 2nd respondent shall conduct an inquiry in respect of allegations after giving due opportunity to the petitioner and pass a reasoned order within a period of thirty days from the date of receipt of a copy of this order. It is needless to state that the 2nd respondent shall consider
the material filed by the petitioner during the course of enquiry.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions pending, if any, in this Writ Petition shall stand closed.
