Notice was ordered to be sent to the parties and accordingly, notice was addressed on 17.08.2022. None represented for appellants so far. Hence, the appeal was listed under the caption "for dismissal". Notice was ordered to the appellant, he was ordered to appear on 24.08.2022 and thereafter the matter was listed on 16.09.2022 under the caption 'for dismissal'. Even today as the appellant failed to turn up, hence, the appeal is dismissed for non prosecution.

In view of the same, the appeal suit is dismissed for non-prosecution. No costs.

As a sequel, all the pending miscellaneous applications shall stand closed.
