THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.1944 of 2015 ORDER:

Upon hearing both sides, at the admission stage, the following Order is passed:

The learned counsel for petitioners would submit that the matter is purely a civil dispute, inasmuch as the first accused has filed O.S.No.1135 of 2008 on the file of I Additional Senior Civil Judge, Rangareddy District at L.B. Nagar, against the vendors of the de facto complainant and obtained interim injunction, which is in force and despite the same, with false allegations, the de facto complainant lodged complaint against petitioners and the police filed Charge sheet without taking into consideration the civil nature of the dispute. The learned counsel submitted that the petitioners/accused will be filing discharge application before the trial Court putting forth all the facts and defences and prayed for a limited stay of the proceedings in C.C.No.66 of 2014 to enable them to file discharge application.

Considering the request of the learned counsel for petitioners/accused as reasonable, the Proceedings in C.C.No.66 of 2014 on the file of Special Magistrate Court, Cyberabad, Hyderabad, are stayed for a period of one month from the date of this order, within which time, the petitioners if advised, can file discharge application before the trial Court, in which case, the trial Court shall dispose of the said application on merits expeditiously.

With the above observation, the Criminal Petition is disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed. ______________________ U.DURGA PRASAD RAO,J 24-03-2015 Note: Issue C.C by 26.03.2015
