HONOURABLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.24689 OF 2019 ORDER (ORAL) :

This writ petition is filed by the petitioner seeking to declare the action of respondent Nos.3 an 4 - Circle Inspector of Police, Shali Gouraram Circle, Shali Gouraram, Nalgonda District, and Station House Officer, Thipparthy Police Station, Thipparthy, Nalgonda District, respectively, in interfering in the civil disputes of the petitioner by calling the petitioner to the police station and threatening him to bow down to their dictates by leaving his agricultural land admeasuring Acs.13.16 guntas situated at Jangareddy gudem village shivar in favour of respondent No.5 in spite of a civil suit in O.S. No.261 of 2019 pending on the file of learned IV Additional District Judge (Fast Track Court) at Nalgonda, as being illegal, arbitrary and unjust.

2. Heard Sri K. Venumadhav, learned counsel for the petitioner, and learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 4, and perused the material on record.

The learned Assistant Government Pleader for Home based on the written instruction dated 13.11.2019, a copy of which is placed before this Court, submits that pursuant to a complaint of unofficial respondent No.5 herein viz., Arrabolu Venkat Reddy against the petitioner alleging that the petitioner along with others entered into his

land and damaged cotton crop with the help of tractor and caused loss, a case was registered against the petitioner in Crime No.91 of 2019 on 08.08.2019 on the file of respondent No.4 and is under investigation for collection of evidence and for service of notice under Section 41(A) of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), on the accused therein and in that connection, petitioner was called. He further submits that the petitioner also gave a complaint against the unofficial respondent No.5 and based on the same, a case in Crime No.82 of 2019 has been registered on 20.07.219 on the file of respondent No.4 and is under investigation. It is stated that notice under Section 41(A) of Cr.P.C. was served on the accused on 24.07.2019. Learned Assistant Government Pleader for Home further submits that respondent Nos.3 and 4 never interfered in the civil disputes between the petitioner and unofficial respondent No.5 at any point of time except conducting investigation in the above two cases registered against and at the behest of the petitioner.

4. In view of the aforesaid submissions of the learned Assistant Government Pleader for Home made on behalf of the official respondents, this Court is of the view that no further orders are required to be passed in the matter.

5. Therefore, recording the submissions of the learned Assistant Government Pleader for Home, the writ petition is closed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition stand closed.
