HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.9372 of 2017 ORDER :

Heard the learned counsel for the petitioner/ accused, who is the Chief Executive Officer of Dhanalakshmi Mutually Aided Cooperative Thrift Society Limited, Hyderabad and the learned Public Prosecutor representing the State before ordering notice to the 2nd respondent/ de facto complainant and perused the grounds urged in the quash petition, F.I.R. and report of the petitioner against the de facto complainant covered by Crime No.194 of 2017 dated 11.09.2017, which is four days prior to the report covered by the present Crime No.180 of 2017 dated 15.09.2017.

The contention of the learned counsel for the petitioner/ accused that it is a counter-blast to the earlier report given by him, which is the matter, requires investigation. Hence, there is nothing to interdict the investigation, but for, to say pending investigation, the petitioner shall not be arrested. However, it will not prevent the Police to secure the presence of the petitioner for the purpose of investigation as and when required.

Accordingly, the Criminal Petition is disposed of. All the defences are left open.

Consequently, miscellaneous petitions, if any, pending shall stand closed.
