Heard counsel for the petitioner and Smt K.Lalitha, Standing Counsel for respondents.

Petitioner has filed this Writ Petition seeking release of his pensionary benefits, since the petitioner was allowed to retire voluntarily by the respondents on 17/21-06-2016. 3.

The Standing Counsel for the respondent, Smt K.Lalitha, states that before it could release the retirement benefits of the petitioner, it had received attachment orders from the Civil Courts for attachment of the amounts payable to the petitioner and that therefore, the amounts could not be released. However, the Standing Counsel states that the respondent would release the amounts payable to the petitioner on his voluntary retiring from service to the extent they are not attached by the Civil Courts 4.

Recording the said submissions, this Writ Petition is disposed of directing the respondent to release the portion of the retirement benefits payable to the petitioner, which are not subject to the attachment orders passed by the Civil Courts. Petitioner is also granted liberty to approach the Civil Courts for raising the attachment orders passed by the said Courts. There shall be no order as to costs.

Consequently, miscellaneous Petitions pending if any, shall stand closed.
