HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 21034 of 2016 ORDER:

Heard learned counsel for the petitioner, Government Pleader for Municipal Administration and Urban Development, and Sri N.Ashok Kumar, learned Standing Counsel for G.H.M.C. There is no necessity to put the unofficial respondent on notice as this Court is not venturing to adjudicate the issue on merits.

The present writ petition is filed with the following prayer: "Issue a writ of mandamus or any other appropriate writ, order or direction, declaring the action of the second respondent in not considering and taking action on the complaints made by the petitioner dated 16.05.2016 and 31.05.2016 in respect of demolition of illegal constructions without municipal permission made by the third respondent in plot No.15 bearing GHMC No.9-4-116/15 situated at Balreddy Nagar, Tolichowki, Hyderabad, as arbitrary, illegal and contrary to the provisions of HMC Act, 1955; and consequently to direct the second respondent to consider the complaints dated 16.05.2016 and 31.05.2016 and to demolish the illegal construction of the building."

Learned Standing Counsel for G.H.M.C. submits that if any illegal constructions are made in the said plot, the authorities will take appropriation action in accordance with law. It is also brought to the notice of the Court that the complaints of the petitioner dated 16.05.2016 and 31.05.2016 will be considered in accordance with law, if the same are pending.

In view of the submission made by the learned Standing Counsel for G.H.M.C., the present writ petition is disposed of directing the respondent authorities to consider the complaints dated 16.05.2016 and 31.05.2016 made by the petitioner, in accordance with law after hearing the petitioner and all the persons concerned including the aggrieved persons, as expeditiously as possible, preferably within a period of six (06) weeks from the date of receipt of a copy of the order, if the same are still pending consideration. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
