O R D E R
Aggrieved by the action of the 3rd respondent - Station House Officer / Sub Inspector of Police, in not registering the crime in pursuance of the reports filed by the petitioner on 20.12.2017 and 22.1.2018, the present writ petition is filed.
Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Home produced written instructions of the 3rd respondent stating that the allegations of the petitioner in the reports are civil in nature and informing the same, petitioner was served with notice dated 28.01.2018.
As the counsel for the petitioner disputed the service of any notice on the petitioner, this court by docket order dated 03.07.2018 directed the 3rd respondent to inform the court the mode of service on the petitioner. Learned Assistant Government Pleader for Home could not produce the mode and proof of service on the petitioner.
Having regard to the facts and circumstances, 3rd respondent is directed to following the guidelines laid down by the Apex Court in LALITA KUMARI v. GOVERNMENT OF UPPAR PRADESH1 and take appropriate action in accordance with law.
Writ petition is disposed of accordingly.
