THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.42933 OF 2015 ORDER:

The grievance of the petitioner is with regard to the seizure of his vehicle bearing No.KA39 6116 seized under vehicle check report No.2523797 dated 25.12.2015 by the Assistant Motor Vehicles Inspector, Regional Transport Authority, Ranga Reddy District. Sri B. Siva Rama Krishnaiah, learned counsel for the petitioner, placed reliance on the order dated 14.11.2013 passed by this Court in W.P.No.32666 of 2013 and prayed for disposal of the writ petition in terms of the said order.

Learned Assistant Government Pleader for Transport, having received instructions in the matter, fairly conceded that the same order may be passed in the present writ petition.

For reasons alike as were mentioned in the order dated 14.11.2013 passed in W.P.No.32666 of 2013 and in terms thereof, the writ petition is disposed of leaving it open to the petitioner to file an application to the second respondent seeking release of the vehicle and if any such application is filed, the second respondent shall consider the petitioner's application in the light of the law declared by the Division Bench in SALEEM TOURS AND TRAVELS V/s. JOINT TRANSPORT COMMISSIONER AND SECRETARY, RTA, HYDERABAD[1] and the learned Single Judge in SHOUKAT HUSSAIN V/s. DEPUTY TRANSPORT COMMISSIONER AND SECRETARY, REGIONAL TRANSPORT AUTHORITY, ADILABAD[2] and pass orders thereupon at the earliest and in any event, not later than three days from the date of receipt of the petitioner's application.
