THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.7851 of 2006 ORDER :

In this Writ Petition, the petitioner has assailed the order dt.31.12.2005 of the respondent rejecting petitioners' application for grant of building permission on the ground that the said land belongs to respondent.

2. The counsel for petitioners states that petitioners have filed O.S.No.261 of 2014 before the I Additional District Judge, Guntur for declaration of title of petitioners to the subject land, and that the said suit is pending. 3.

Since petitioners had already approached the competent Civil Court for adjudicating their title to the land, this Court is not inclined to entertain the Writ Petition, and decide the question of title to the subject land between petitioners and respondent.

4. Therefore, granting liberty to petitioners to get their right, title and interest in the property adjudicated in O.S.No.261 of 2014, this Writ Petition is dismissed. No order as to costs.
