Sri Sreepuram Sreenivasulu Chetty, v. M/ S. The Mercantile Benefit Corporation (In Liqn.),
THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA ORIGINAL SIDE APPEAL No. 4 of 2014 JUDGMENT: (Per VRS,J) There has been no representation for the appellant for quite some time. It appears from the proceeding sheet that there was no representation for the appellant on 28.03.2014 and 01.04.2014. On 02.04.2014, the interim order earlier granted was vacated on the ground that the condition imposed therein had not been complied with. Again on 14.06.2016 when the appeal was posted for final hearing, there was no representation for the appellant. Hence, the matter was adjourned to today under the caption "for dismissal". Even today, there is no representation for the appellant. Hence, the Original Side Appeal is dismissed for non-prosecution.
Consequently, miscellaneous petitions if any pending in the appeal shall stand dismissed. There shall be no order as to costs.
