THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 8901 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused No.5 seeking bail in the event of his arrest in connection with Crime.No.252 of 2021 on the file of Mallapur Police Station, Jagtial District, registered for the offences under Sections 120-b, 147, 148, 341 and 307 r/w. 149 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The petitioner herein is shown as absconding in the charge sheet.

Learned counsel appearing for the petitioner would submit that charge sheet is pending as PRC.No.4 of 2022 before the Judicial First Class Magistrate, Metpally and the case is posted on 26.09.2023.

Since the investigation is complete and trial is underway, this Court deems it appropriate to direct the petitioner to surrender on 26.09.2023 before the concerned

Court and file an application for recall of warrants and on filing of such application, the Court below shall consider the same and recall the warrants on conditions without hindrance to trial.

With the above observation, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
