THE HON'BLE SRI JUSTICE A.V. SESHA SAI CIVIL MISCELLANEOUS APPEAL No.958 of 2009 JUDGMENT:

This appeal, filed under Order 43 Rule 1 of the Code of Civil Procedure, assails the order, dated 22-12-2008 passed by the Court of I Addl. District Judge, Srikakulam in I.A.No.191 of 2007 in O.S.No.24 of 2007.

In I.A.No.191 of 2007, filed under Order XXXIX Rule 1 of Code of Civil Procedure by the plaintiffs/respondents herein, the Court below granted an order of status quo. The said order is under challenge in the present Civil Miscellaneous Appeal. When the matter is called today, it is submitted by learned counsel for the appellants that the arguments in the suit are already over and a direction may be issued to the Court below to dispose of the suit, in accordance with law, as expeditiously as possible.

Recording the said submission, the Civil Miscellaneous Appeal stands closed, directing the Court below to dispose of O.S.No.24 of 2007, as expeditiously as possible, as per law. There shall be no order as to costs.

The Miscellaneous Petitions, if any, pending in this Civil Miscellaneous Appeal shall stand closed.
