HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.17102 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The Writ Petition is being disposed of at the stage of admission with the consent of parties.

The petitioner was appointed as a fair price shop dealer of Thirumalapur Village, Doulthabad Mandal, Medak District. While so, the Assistant Civil Supply Officer, Siddipet visited the shop of the petitioner and noticed some variation in stock, and initiated 6-A proceedings against her. The third respondent issued a show cause notice dated 15.05.2015. The petitioner submitted her explanation, which was received by the third respondent on 30.05.2015. An enquiry into the said allegations is pending. The present Writ Petition is filed seeking release of stock so long as the authorisation of the petitioner is in force.

A perusal of the show cause notice dated 15.05.2015 does not indicate any cancellation of dealership or authorization. The petitioner already submitted her explanation and an enquiry, pursuant to the show cause notice, is pending. Needless to mention that, so long as the authorization of the petitioner is in force, the petitioner is entitled to receive stock and distribute the essential commodities to the cardholders.

In the circumstances, the third respondent is directed to release the stock so long as the authorization of the petitioner is in force, and complete the enquiry as expeditiously as possible.

The Writ Petition is, accordingly, disposed of at the stage of admission. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. No order as to costs.
