HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.7922 OF 2017 ORDER:
The case of the petitioner is that it is a registered trust bearing No.5234/2004-2005 and the main object of the petitioner trust is to help the poor people more particularly the mental and physically challenged persons by way of facilitating the Orphanage, Hospital, Education etc. With an intention to extend its services in Telangana State, the petitioner had purchased the land admeasuring Ac.60-00 guntas., situated at Veliminedu Village of Chityal Mandal, Nalgonda District by virtue of registered sale deeds for valid sale consideration. While so, the 4th respondent issued a show cause notice dated 10.02.2017 to the petitioner under Rule 3 of the A.P.Assigned Lands (Prohibition of Transfer) Rules, 2007. Pursuant to the said notice, the petitioner trust submitted its explanation on 21.02.2017. But the 4th respondent without passing final orders is trying to dispossess the petitioner. Aggrieved by the same, the present writ petition is filed.
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue. Since it is stated that petitioner already filed explanation on 21.02.2017 to the show cause notice dated 10.02.2017, it is for the 4th respondent to dispose of the same in accordance with law.
In view of the same, the 4th respondent is directed to pass final orders in pursuant to the show cause notice dated 10.02.2017, after affording an opportunity of hearing to the petitioner. Till passing of final orders, there shall be stay of dispossession of the petitioner.
With the above direction, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 07.03.2017 dv
