THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NOS.8853 & 8882 OF 2023 COMMON ORDER:

Criminal Petition 8853/2023 is filed by the Accused No.7 and Criminal Petition No.8882 of 2023 is filed by Accused No.6 under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail in Crime No.531 of 2023 on the file of IX Additional Metropolitan Magistrate at Medchal, Cyberabad, registered for the offences punishable under Section 20(b)(ii)(B) and 22(b) of the NDPS Act.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The Sub-Inspector of Police, Medchal arrested these persons while getting down from the bus. In all seven persons were identified. Out of them, the petitioners are A6 and A7. While conducting search 1 Kg. ganja was found from A6 and from A7 also 1 Kg. ganja was found.

Since it is stated by the learned Assistant Public Prosecutor that there no criminal cases pending against the petitioners and since the contraband is small quantity, this Court inclined to grant the relief of regular bail to the petitioners subject to the following conditions: i) The petitioners/A6 & A7 shall execute personal bonds for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties for a like sum each to the satisfaction of IX Additional Metropolitan Magistrate at Medchal, Cyberabad.

ii) The petitioners/A6 & A7, after release, shall appear before the concerned Station House Officer every Monday and Wednesday between 10.30 AM and 01.00 PM., for a period of eight weeks or till filing of charge sheet, whichever is earlier, for the purpose of investigation.

iii) The petitioners/A6 & A7 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 7.

Accordingly, both the criminal petitions are allowed. Miscellaneous applications, pending if any, shall stand closed.
