THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NOS.8954 & 8968 OF 2023 COMMON ORDER:

These Criminal Petitions are filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.5 and respectively in Crime.No.531 of 2023 on the file of Medchal Police Station, Cyberabad, registered for the offences under Section 20 (b) (ii) (B), 22(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Since the petitioners in both the petitions are accused Nos.5 and 4 respectively, in the very same crime, both the petitions are heard together and disposed off by this common order.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondentState and perused the record.

It is alleged by the Medchal Police that when have conducted search near CMR college, several persons were apprehended for being in possession of drugs. The allegation against A-4 is that he was in possession of 2 kgs of dry ganja and A-5 was found in possession of 13gms of ketamin drug.

The commercial quantity of ganja is 20 kgs. and the commercial quantity of ketamin drug is 500 gms. Since the quantity seized is intermediary quantity, these petitioners can be granted the relief of regular bail, subject to following conditions:
i) The petitioners/Accused Nos.5 and 4 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties, for a like sum each to the satisfaction of IX Additional Metropolitan Magistrate at Medchal, Cyberabad.
ii) The petitioners/Accused Nos.5 and 4 after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday and Wednesday for a period of eight weeks and
thereafter, as and when required for the purpose of investigation.
iii) The petitioners/Accused Nos.5 and 4 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, these Criminal Petitions are allowed. Miscellaneous applications, pending if any, shall stand closed.
