HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 19890 of 2003 ORDER:
This writ petition is filed seeking to issue a writ of certiorari calling for the records in connection with I.D.No.149 of 2000 on the file of the 2nd respondent - Labour Court and quash the award dated 12.11.2002 passed therein, holding it as illegal and arbitrary. When the matter is taken up for hearing, learned counsel on either side have fairly conceded that the issue raised in the writ petition is squarely covered by the judgment dated 22.06.2017 passed by a Division Bench of this Court in W.A.No.806 of 2017 and batch and prayed that similar orders may be passed in this writ petition. The operative portion of the said judgment reads as under: "Following the order of the Supreme Court in Civil Appeal No.3529 of 2017 and batch dated 23.02.
2017, these writ appeals are also disposed of holding that the benefit of Section 47 of the Act shall be available only to those who are covered by the disabilities specified in Section 2(i) of the Act; it is open to the appellate-Corporation to take a decision, on individual grievances of the respondent-writ petitioners, with utmost expedition preferably within three months from the date of receipt of a copy of the order; and the respondentwrit petitioners are at liberty thereafter to avail their remedies in terms of the judgment of the Supreme Court." In view of the above, this writ petition is also disposed of in terms of the aforesaid judgment dated 22.06.2017 passed in W.A.No.806 of 2017 & batch.
