HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT Writ Appeal No. 383 of 2015 Judgment: (Per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.
This writ appeal was filed in May, 2015 and interim order as prayed for was granted on 14.5.2015. By way of interim order, the appellant sought suspension of the order passed by the learned Single Judge in Writ Petition No. 13947 of 2015. The interim order passed by the learned Single Judge reads thus:
"Notice before admission.
There shall be interim direction as prayed for. Post after Summer Vacation of 2015."
The direction sought in the writ petition was to permit the 1st respondent-writ petitioner to appear for B.Tech. III year II Semester examinations and B.Tech. III year I Semester Supplementary examinations for backlog subject. In pursuance of this order, the 1st respondent-writ petitioner appeared for the examinations, which were due at that stage. We are informed that the next examinations will be held some time in December, 2015. Keeping that in view and considering the nature of interim order passed in the writ petition and the instant writ appeal, learned counsel for the parties have agreed for disposal of the appeal in the following terms:
"The order passed by the learned Single Judge in the writ petition shall remain suspended till the hearing and final disposal of the writ petition. Leaned Single Jude is requested to hear and dispose of the writ petition, as expeditiously as possible, and preferably, before December, 2015. All contentions of the parties on merits are kept open. It is made clear that this Court has not dealt with the case on merits." The writ appeal is disposed of.
Consequently, pending miscellaneous applications shall also stand closed. No costs.
