Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.
2. The petitioner was appointed as a fair price shop dealer of shop No.8 of Lingampalem Village, V.V.Palem Mandal, Prakasam District. The authorization of the petitioner is valid upto 31.03.2016. While so, the shop of the petitioner was inspected on 31.01.2015 in the absence of the petitioner and a panchanama was conducted on that day in respect of the variation in quantities and the commodities were seized. Based on the report of the Food Inspector, the fourth respondent issued a show cause notice on 04.02.2015 and the petitioner submitted his explanation on 16.02.2015. After receiving the explanation, the fourth respondent passed an order on 04.03.2015 cancelling the authorization of the petitioner. Challenging the same, the petitioner filed an appeal to the third respondent, who confirmed the order of the fourth respondent, by his order dated 26.06.2015. Against the said order, the petitioner preferred a revision before the second respondent on 31.07.2015, and when no orders were passed thereon, he filed the present writ petition. 3.
In view of the pendency of the revision before the second respondent, this Court is not inclined to go into the merits of the case. The petitioner preferred the above revision with relevant case law and therefore the second respondent is directed to dispose of the revision in accordance with law within a period of 60 days from the date of receipt of a copy of this order.
4. The writ petition is, accordingly, disposed of. No order as to costs. Miscellaneous Petitions, if any pending, shall stand closed.
