THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 24726 of 2019 ORDER:

In this Writ Petition, petitioner challenges notice dated 04.11.2019 issued by the third respondent - Greater Hyderabad Municipal Corporation, rep. by its Deputy Commissioner, Circle No.27, Alwal, Medchal-Malkajgiri District, directing him to stop construction activity on the ground that he did not obtain prior permission therefor.

As it is the mandate of the law that before making construction even with respect to the site admeasuring 100 sq.yards, permission is required to be obtained from the authorities concerned, and inasmuch as there is no permission obtained by the petitioner for making construction in the subject land, no fault can be found on the part of the respondent authorities in issuing the impugned notice directing the petitioner to stop the construction activity.

In those circumstances, this Writ Petition is closed. It is made clear that the petitioner shall not make construction in the

CKR, J W.P.No.24726 of 2019 subject land without obtaining prior permission as mandated in law.

Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
