THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 8884 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioners/A1 to A4 seeking bail in the event of their arrest in connection with Crime No.130 of 2023 on the file of Chintapally Police Station, Nalgonda District, registered for the offences punishable under Section 307 of the Indian Penal Code.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record. 3.

The allegations against the petitioners are that on 10.08.2023 in the night, the injured together played Halav near Savwadi at Peerla Festival near Grampanchayath in Mallareddypally village in front of Baikani Veeraiah's house, in the meantime, the accused Nos.1 to 4 brought beer bottles and stones with them and attacked on the injured i.e.Gandu Prabhakar and Bodaiah with an intention to kill them by keeping old disputes in mind, as a result of which Prabhakar received severe injury on his left eye and Bodaiah received severe head injury. 4.

Learned Additional Public Prosecutor on instructions would submit that the injuries received by the victims are simple in nature and they were treated as out-patients.

Keeping in view that there are disputes in between the families, this Court inclined to grant Anticipatory Bail to the petitioners in the event of their arrest, subject to the following conditions:

1) The petitioners/A1 to A4 are directed to surrender before the Station House Officer, Chinthapally Police Station, Nalgonda District, on 25.09.2023. On such surrender, the said Station House Officer shall release the petitioners/A1 to A4 on bail, on their executing personal bonds for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioners/A1 to A4 shall appear before the concerned police on every Monday and Wednesday between 10.00 a.m. to 1.00 p.m. for a period of two months, for the purpose of investigation.

3) The petitioners/A1 to A4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
