The petitioner was appointed as fair price shop dealer of shop No.36 of Pyalakurthy Village in Kodumur Mandal of Kurnool District on permanent basis. Based on the report of the Deputy Tahsildar (CS),

Gudur, dated 22.06.2015, the third respondent-Revenue Divisional Officer, Kurnool, by order dated 11.07.2015, suspended the authorization of the petitioner in respect of certain irregularities alleged to have been committed by her. Aggrieved by the suspension of her authorization, the petitioner preferred an appeal before the second respondent-Joint Collector, Kurnool on 19.08.2015 along with the application for stay of the order dated 11.07.2015 of the third respondent. When the stay application was not disposed of, the present writ petition is filed.

The learned counsel for the petitioner submits that no show cause notice whatsoever has been given nor conducted any sort of preliminary enquiry and by making vague allegations only, the third respondent suspended the authorization of the petitioner. However, in view of the pendency of stay application along with the appeal before the second respondent, this Court thinks it fit to dispose of the present writ petition by directing the second respondent to take up the stay application of the petitioner and pass appropriate orders thereon, within a period of one week from the date of receipt of a copy of this order and thereafter, the appeal itself can be taken up for hearing and after due notice and opportunity to the petitioner, the same shall be disposed of, within a period of 60 days from the date of disposal of stay application.

With the above directions, the writ petition is disposed of. There shall be no order as to costs. The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. _______________________________ A. RAMALINGESWARA RAO, J Date: 24.08.2015 Isn
