HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.45308 of 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioners seeking to declare the action of the 2nd respondent in not disposing of the stay applications filed by the petitioners along with respective revenue appeals filed by them, as illegal and arbitrary.

Heard the learned counsel for the petitioners and the learned AGP for Revenue for respondents. With their consent, the writ petition is disposed of at the stage of admission itself. The limited grievance of the petitioners in this writ petition is that though they filed stay applications on 04.08.2016 along with appeals before the 2nd respondent questioning the proceedings dated 02.07.2016 in ROC No.12/2016/B, till date no orders are passed.

Learned AGP would submit that the 2nd respondent may be directed to dispose of the stay applications, if not already disposed of, in accordance with law.

Having regard to the rival submissions made and considering the fact that the petitioners are in possession since last thirty years, the Writ Petition is disposed of directing the 2nd respondent to dispose of the appeals filed by the petitioners, in accordance with law, after hearing the petitioners and other aggrieved persons, if any, as early as possible, preferably within a period of eight weeks from the date of receipt of a copy of this order. If the 2nd respondent is not in a position to dispose of the

appeals, he shall dispose of the stay applications filed along with the appeals, in accordance with law, at the earliest, preferably within a period of two weeks, from the date of receipt of a copy of this order.
