N.Purushottam Reddy v. The State Of Telangana.,Rep.,Pp And 2 Others
HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND THE HON'BLE SRI JUSTICE S.V. BHATT Criminal Petition No.9325 of 2017 ORDER: (per the Hon'ble the Chief Justice Sri Thottathil B. Radhakrishnan) This Criminal Petition is instituted seeking interference with the lodging of a FIR on the basis of a complaint made by a person. 2.
We have heard the learned counsel for the petitioner and the learned Public Prosecutor.
3.
The complaint raised through the FIR relates to an allegation of forgery of signatures. The petitioner has also contended that certain prior sanctions are required for the purpose of prosecution. These are issues which would in usual course be entertained by the jurisdictional Criminal Court. Similarly, the question of the territorial jurisdiction of the Station House Officer before whom the FIR is lodged is also a matter that is relatable to issues that may arise post investigation if at all the matter goes up to that stage. We do not see any ground of extraordinary circumstance warranting this Court to interfere either under Section 482 Cr.P.C or under Article 227 of the Constitution of India with the impugned lodgment of FIR. 4.
We accordingly dismiss this Criminal Petition leaving open all issues to be raised by the petitioner or the complainant before the appropriate judicial authority if and when the case is taken up for consideration by it. Pending miscellaneous petitions, if any, shall also stand dismissed. _________________________________________ THOTTATHIL B. RADHAKRISHNAN, CJ Date: 22.11.2018 ________________ S.V. BHATT, J va
