THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION NO.21657 OF 2018 ORDER:

The petitioners invoked the jurisdiction of this Court apprehending dispossession of petitioners from an extent of Acs.4.90 cents in Boddapuvanipalem Village, E.Bonangi, Parawada Mandal, Visakhapatnam District without recourse to law, as illegal, arbitrary and unconstitutional. On 27.06.2018, the Writ Petition has been adjourned at the instance of respondents for getting instructions on the material allegations made by the petitioners. The Assistant Government Pleader places on record instructions dated 28.06.2018. The third respondent places on record the following instructions.

"I submit that as seen from the Revenue records the petitioners' names are not recorded in any revenue records and D-patta was not granted to the petitioners. I further submit that we are not interfere any encroachment in the land Survey No.251/1 only vacant land was identified for weaker section layout under NTR housing scheme. We never disturb the encroacher for issuing notice under Land Encroachment Act, 1905." By placing on record the instructions, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
