JUDGMENT
Appellant/Plaintiff has filed O.S.No.457 of 1996 on the file of XI Assistant Civil Judge, City Civil Court, Secunderabad, for recovery of money. The trial Court decreed the suit. The unsuccessful defendants preferred appeal vide A.S.No.24 of 1998 wherein the appellate Court dismissed the appeal, against which the second appeal has been filed 2.
A perusal of the docket proceedings shows that the learned counsel for the appellant did not evince any interest to pursue the second appeal proceedings. On 11.08.2023, as there was no representation on behalf of the learned counsel for the appellant, the matter was directed to be listed under the caption Yor dismissal. Even today also, there is no representation for the appellant. No purpose would be served in continuing the Second Appeal 3.
Accordingly, the Second Appeal is dismissed. No order as to costs.
