THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.5741 OF 2017 ORDER:
This writ petition is filed challenging the action of the third respondent in insisting the petitioner to yield and settle to the terms of the fourth respondent even though the matter between the petitioner and the fourth respondent is a civil dispute.
Learned Government Pleader appearing for respondents 1 to 3 submits that the averments made in the writ petition are false and denied. The fourth respondent filed a separate counter affidavit denying purchase of the property under an agreement of sale, dated 24.09.2012 by the petitioner. The fourth respondent denies execution of any such agreement of sale.
In the circumstances, this Court feels that there is no ground to grant any relief to the petitioner. However, it is open to the petitioner and the fourth respondent to work out their remedies in accordance with law. Insofar as third respondent is concerned, he shall not interfere with the civil disputes and if any crime is registered, it is open to him to investigate the same in accordance with law.
The writ petition is accordingly disposed of. Consequently, miscellaneous petitions pending, if any, shall also stand closed. __________________________ A.RAMALINGESWARA RAO, J 15.03.2017 pln
