THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 22067 of 2016 ORDER:
Heard learned counsel for the petitioners and learned Government Pleader of Home.
With the consent of both the parties, the writ petition is disposed of at the admission stage.
The grievance of the petitioners is that respondent Nos.3 is interfering with the civil dispute by calling them to the police station frequently at the instance of respondent No.4. The averments in the affidavit filed in support of the writ petition would show that respondent No.4 filed a suit for permanent injunction and also rectification of revenue records before the Principal Junior Civil Judge, Huzurabad against the petitioners and Tahasildar, Elkathurthy Mandal. Subsequently, the suit was decreed and the petitioners filed A.S.No.3 of 2013 on the file of Senior Civil Judge, Huzurabad, which was dismissed, leading to filing of S.A.No.276 of 2014 before the High Court. It is stated that the petitioners also moved an application seeking suspension of the judgment and decree in the Original Suit.
It is the case of the petitioners that while S.A.No.276 of 2014 is pending, respondent No.4, in collusion with respondent No.3, are threatening the petitioners to dispossess them from their land and also frequently calling them to the police station to settle the matter with respondent No.4.
Having regard to the above circumstances, the present writ petition is disposed of directing the respondent - police authorities to be mindful of the limits of their jurisdiction in criminal law and not to interfere with any civil dispute, except following due process
of law.
