HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.18493 of 2013 ORDER:

Heard the learned counsel for the petitioner as well as the learned Government Pleader appearing for the respondents. The prayer sought in the writ petition is as under: "... to issue a direction, writ, order or orders, particularly one in the nature of writ of mandamus declaring the action of the respondents in not conducting enquiry and not investigating the matter pursuant to the endorsement C.No.37/Pets/2012 of the respondent No.2 to respondent No.3 is arbitrary and illegal and consequently issue a direction to the respondents to investigate into the matter and take necessary action as per law."

The basic grievance of the petitioner is that in spite of an endorsement vide C.No.37/Pets/2012 dated 22.05.2012 of respondent No.2, respondent No.3 is not conducting any enquiry and investigation. During the course of hearing, the learned Government Pleader placed on record the written instructions dated 15.07.2013 issued by the Station House Officer, Vemulawada Police Station, Karimnagar District. A perusal of the said instructions would reveal that the persons against whom the complaint was lodged by the petitioner, on enquiry, revealed that they have not damaged and committed theft of iron rods as alleged by the petitioner. It is also mentioned in the written instructions that the petitioner is in the habit of filing false complaints before the Station House Officer, Vemulawada.

It is also mentioned that the number of false cases filed by the petitioner, on enquiry, were referred as false. In view of the same, this Court is of the opinion that no further orders are required in the writ petition and the same is liable to be dismissed. Accordingly, the writ petition is dismissed. No costs. Miscellaneous petitions, if any, shall also stand dismissed. _____________________ P. KESHAVA RAO, J Date: 22.11.2018.
