Duddilla Aruna Devi v. The State Of Telangana,
HONOURABLE SRI JUSTICE P.NAVEEN RAO Between:
Duddilla Aruna Devi W/o late D.Ananda Rao, Aged 65 years, Occu: Household, r/o.4-27, Shankarampally, Dhanwada village, Kataram Mandal, Jaya Shankar Bhupalpalli district.
.....Petitioner and The State of Telangana, rep.by its Principal Secretary, Revenue Department, Secretariat, Hyderabad and others.
.....Respondents The Court made the following:
PNR,J W.P.No.26087 of 2017 HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:
Petitioner claims to be the owner of land to an extent of Ac.3.32 guntas in Sy.No.290 in Dhanwad village, Kataram Mandal, Jaya Shankar Bhupalpalli district. Petitioner alleges that revenue records should be updated to reflect the name of the petitioner, whereas wrong entries are made.
2.
Learned counsel for petitioner submits that representation was made on 09.06.2014 requesting to rectify the wrong entries made in the revenue records. Admittedly, no application, as required by the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971, is made by the petitioner. The question of entertaining the representation and acting upon such representation does not arise, when the statute prescribes a particular mode of seeking appropriate entries in the revenue records/corrections. Thus, it cannot be said that there is inaction on the part of the statutory authority in acting as per the request made for appropriate corrections in the revenue records, warranting interference by this Court. Thus, leaving it open to the petitioner to work out her remedy as available in law, writ petition is dismissed.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ___________________________ JUSTICE P.NAVEEN RAO kkm
